Peshala ordered to pay compensation

The Supreme Court had ordered the former Chief Minister of the North Central Province, Peshala Jayaratne, to pay Rs 250,000 as compensation to a school principal who had filed a case against him over an unfair transfer. In addition he was also ordered to pay Rs 50,000 as compensation to the petitioner.

The aggrieved party was the former Principal of the Niwaththaka Chethiya Maha Vidyalaya in Anuradhapura in 2016.

The verdict was issued by a three member Supreme Court judge panel including Eva Jayasundara ordering that within two months from today the relevant transfer should be cancelled and the said principal be reinstated in the previous appointment.

 In his petition, the principal Karunaratne Bandara had said that he was transferred by the chief minister on charges that he had failed to organize properly the foundation laying ceremony of his school on September 09, 2016

 He said that although he had appealed against the decision, it had been rejected, adding that this had violated his fundamental rights and therefore sought a court order revoking the said transfer.

The Supreme Court ruling in favour of the petitioner, declared that the North Central Province Chief Minister had violated the fundamental rights of the petitioner through the transfer order.
